Depending on the circumstances, Possession of Marijuana can be either a felony or a misdemeanor in Arizona. The Arizona law that prohibits the possession of marijuana is A.R.S. section 13-3405. The law states that a person shall not knowingly:
- Possess or use marijuana; or
- Possess marijuana for sale.
CLASSES OF FELONY
- A person who is convicted of possessing or use marijuana, involving an amount of marijuana not possessed for sale, having a weight of less than two pounds, is guilty of a class 6 felony.
- A person who is convicted of possessing or use marijuana, involving an amount of marijuana not possessed for sale, having a weight of at least two pounds but less than four pounds, is guilty of a class 5 felony.
- A person who is convicted of possessing or use marijuana, involving an amount of marijuana not possessed for sale, having a weight of four pounds or more, is guilty of a class 4 felony.
- A person who is convicted of possessing marijuana for sale, involving an amount of marijuana having a weight of less than two pounds, is guilty of a class 4 felony.
- A person who is convicted of possessing marijuana for sale, involving an amount of marijuana having a weight of at least two pounds but not more than four pounds, is guilty of a class 3 felony.
- A person who is convicted of possessing marijuana for sale, involving an amount of marijuana having a weight of more than four pounds, is guilty of a class 2 felony.
